You are probably aware that cigarette smokers who have gotten sick have sued the tobacco companies for product liability negligence. You need not research the history of these type of litigations, but for this module’s discussion question I would like you to make some basic arguments for the Plaintiff (smokers) or Defendants (Tobacco Companies) using some of the main legal concepts we have learned about in this Module. Here are the minimum concepts I want you to cover: 1) Duty to Care, 2) Proximate Cause, 3) Assumption of Risk and 4) Strict Liability. You may think of others on your own, but at least cover those 4. Argue for either side or both, but be sure you show that you understand those legal concepts.
